James v Hertsmere BC [2020] EWCA Civ

Summary

In this case the contracting out of the council's Section 202 Review function was challenged as being unlawful. The Court held that the issue of contracting out came within the scope of an appeal under Section 204 of the Housing Act 1996 but in this case the council was allowed to retrospectively approve the extension of the contracting out function after the contract itself had expired.
