The House of Lords case R (G) v Southwark  UKHL 26 held that, where a 16 or 17 year old is owed duties under section 20 of the 1989 Act, this takes precedence over the duties in the 1996 Act in providing for children in need who require accommodation. Where the specific duty is owed under section 20 of the 1989 Act, a 16 or 17 year old should be accommodated under that provision rather than looking to the general duty owed to children in need and their families under section 17 of the 1989 Act
This case along with another of others around the same time led to the Government publishing Guidance on The Provision of Housing For 16 and 17 Year Olds in 2010
